West Virginia Bill Improved – Secondary Asbestos Exposure (Mesothelioma) Victims Still Protected

The West Virginia Senate Judiciary Committee substantially improved SB411, the so-called Asbestos Bankruptcy Trust Claims Transparency Act and Asbestos and Silica Claims Priority Act. While it is still our belief that no bill is or was necessary, the recent revisions substantially reduce the impact of the worst provisions of the bill.

As we have stated, West Virginia has had an existing case management order for asbestos claims for over 12 years, which has handled these cases efficiently and effectively. We will continue to monitor the progress of the bill as it moves on to the full Senate and House, and will continue to fight for the rights of victims of asbestos and mesothelioma (commonly referred to as meso) in Charleston, Parkersburg, Wheeling and throughout the great state of West Virginia.
