Asbestos Cases — We have recovered millions of dollars over the years on behalf of our clients who have been directly and indirectly exposed to asbestos and asbestos-containing products which were designed, manufactured, distributed and utilized by many companies and at many locations in West Virginia. Described below, are some of these cases.

Mesothelioma Trial – American Electric Power Employee

Harvit & Schwartz, L.C. represented the family of an employee of American Electric Power who contracted mesothelioma after many years of occupational exposure to asbestos. The case against a number of companies that had manufactured asbestos-containing products was successfully resolved.

Two Mesothelioma Trials – Local Insulator Union and Union Carbide Employee

In September 2003, Harvit & Schwartz, L.C. represented the family of a Local 80 Union Insulator as well as the family of an employee of Union Carbide, both of whom contracted mesothelioma after decades of exposure to asbestos-containing products. Harvit & Schwartz, L.C. filed suit against many of the manufacturers of asbestos-containing products, proved their clients exposure to these products and successfully resolved the cases at trial.

Mesothelioma Trial – Local 80 Insulator

Harvit & Schwartz, L.C. represented the family of a Local 80 Insulator who contracted mesothelioma after many years of occupational exposure to asbestos. The case was set for trial in April, 2004 before judges appointed by the West Virginia Supreme Court of Appeals. After proving their client was exposed to asbestos-containing products manufactured by multiple defendant companies, the case was successfully resolved.

Two Mesothelioma Trials – Union Carbide Employees

Two clients of Harvit & Schwartz, L.C. contracted mesothelioma after decades of exposure to asbestos-containing products while employees at Union Carbide Corporation. Both cases were successfully resolved at trial.

Two Mesothelioma Trials – Local 80 Insulators

Both clients, Local 80 Insulators, contracted mesothelioma after many years of exposure to asbestos-containing products at various locations. Harvit & Schwartz, L.C. investigated their exposures and were able to prove which asbestos-containing products were located at each work site. After the trial began, both cases were resolved to the satisfaction of the clients.

Five Mesothelioma Trials – Union Carbide Employees, Local 80 Members & Fourco Glass Employee

Harvit & Schwartz, L.C. represented two Union Carbide Corporation employees, two employees from Local 80 and one employee from Fourco Glass. Before trial, Harvit & Schwartz, L.C. determined the asbestos-containing products to which each client was exposed and the locations of exposure. At trial, each of these cases was presented individually and each was resolved to the satisfaction of each client.

Three Mesothelioma Trials – Two Housewives of Union Carbide Employees & Local 80 Member

We represented a Local 80 Insulator who contracted mesothelioma after many years of exposure to asbestos-containing products. Also, Harvit & Schwartz, L.C. represented the spouses of two former Union Carbide Corporation employees who had contracted mesothelioma and whose ONLY exposure to asbestos was from washing the work clothing of their husbands. After asbestos exposure evidence and other evidence was presented at trial, all three cases were resolved to the satisfaction of each client.

Mesothelioma Trial – Aristech Chemical Employee

Harvit & Schwartz, L.C. represented the family of an employee of Aristech Chemical Company who contracted mesothelioma after many years of occupational exposure to asbestos. The case was successfully resolved at trial in May, 2006.

Five Mesothelioma Trials – Employees of Union Carbide, Goodyear, AC&S and Two Union Members

Harvit & Schwartz, L.C. represented employees from Union Carbide, Goodyear, AC&S and two Union Members, a pipefitter and an insulator. All had contracted mesothelioma from occupational exposure to asbestos-containing products. At trial, each of these cases was presented individually and each was resolved to the satisfaction of each client.

Mesothelioma Trial – Employee of Union Carbide

Harvit & Schwartz, L.C. represented the family of an employee of Union Carbide Corporation who contracted mesothelioma after many years of occupational exposure to asbestos. The case was successfully resolved at trial.

Two Mesothelioma Trials – Employees of Kaiser Aluminum & Union Carbide

Harvit & Schwartz, L.C. successfully represented the family of an employee of Kaiser Aluminum as well as the family of an employee of Union Carbide Corporation, both of whom contracted mesothelioma after decades of exposure to asbestos-containing products. We filed suit, proved the clients’ exposure to asbestos-containing products and successfully resolved both cases at trial.

Two Mesothelioma Trials – Employees of Du Pont and Union Carbide

Two clients contracted mesothelioma after decades of exposure to asbestos-containing products while employees of Du Pont and Union Carbide. Both cases were successfully resolved at trial to the satisfaction of the clients.

Two Mesothelioma Trials – Employees of Du Pont and Union Carbide

We represented the family of an employee of Du Pont as well as the family of an employee of Union Carbide, both of whom contracted mesothelioma after decades of exposure to asbestos-containing products. Both cases were successfully resolved at trial.

Two Mesothelioma Trials – Employees of Union Carbide

We represented two employees of Union Carbide who had contracted mesothelioma from occupational exposure to asbestos-containing products. At trial, each of these cases was presented individually and each was resolved to the satisfaction of each client.

Three Mesothelioma Trials – Steel Workers Union and Union Carbide

Harvit & Schwartz, L.C. represented the family of a member of a Steel Workers Union as well as the family of an employee of Union Carbide, both of whom contracted mesothelioma after decades of exposure to asbestos-containing products. We filed suit against many of the manufacturers of asbestos-containing products, proved their clients exposure to these products and successfully resolved the cases at trial.

Mesothelioma Trial – Employee of Union Carbide

Harvit & Schwartz, L.C. represented the family of an employee of Union Carbide who contracted mesothelioma after many years of occupational exposure to asbestos. During trial, the case was successfully resolved to the satisfaction of the client.

Mesothelioma Trial – Member of Pipefitters Union

Harvit & Schwartz, L.C. represented the family of the member of a Pipefitters Union who had contracted mesothelioma after decades of exposure to asbestos-containing products. Harvit & Schwartz, L.C. successfully resolved the case at trial.

Two Mesothelioma Trials – Union Carbide Employee and a Housewife of Union Carbide Employee

Harvit & Schwartz, L.C. represented an employee of Union Carbide who contracted mesothelioma after many years of exposure to asbestos-containing products. Harvit & Schwartz, L.C. also represented the spouse of a former Union Carbide employee who had contracted mesothelioma and whose ONLY exposure to asbestos was from washing the work clothing of her husband. After asbestos exposure evidence and other evidence was presented at trial, both cases were resolved to the satisfaction of each client.

Mesothelioma Case – Utility Craftsman/Boiler Repair & Maintenance Employee

Harvit & Schwartz, L.C. successfully represented an employee who contracted mesothelioma while working around boilers, steam pipes and other areas where asbestos insulation had been utilized. After proving his exposure to asbestos-containing products, the case was resolved at trial.

Mesothelioma Trial – Spouse of Union Carbide Employee

We represented the spouse of a former Union Carbide employee who had contracted mesothelioma and whose ONLY exposure to asbestos was from washing the work clothes of her husband. After evidence was presented proving that she was exposed to asbestos from her husband’s work clothes, the case was resolved to the client’s satisfaction.
