The West Virginia Senate Judiciary Committee passed a revision to laws allowing settlements of workers’ compensation cases. Until now, a worker could settle his/her claim, but he/she was not able to settle the claim for medical benefits. There was for a good reason for this.

Previously, if you had been allowed to settle your claim for medical benefits in an asbestos related claim you may not have been able to make any future claims related to asbestos exposure. If you had later developed cancer or mesothelioma (commonly known as meso) from exposure to asbestos, you would not have had coverage. Further, you could have jeopardized your coverage with private insurance and possibly federal benefits like Medicare and Social Security.

Now, your claims for medical benefits can be settled, but only if you are represented by counsel. This requires you to consult with an attorney, and because of the significance of the potential injuries and costs associated with mesothelioma or cancer caused by asbestos, we highly recommend consulting with an experienced, local West Virginia attorney.
